Court Lifts Stay Blocking BG&E Customer Choice

LCG, July 21, 2000--Constellation Energy Group Inc. said yesterday that the Maryland Court of Appeals has lifted the stay preventing its Baltimore Gas & Electric Co. subsidiary from putting its customer choice plan into effect for electricity customers.

BG&Es restructuring plan, which includes a six-year, 6.5 percent residential rate cut for residential customers, had been scheduled to go into effect on July 1, along with plans of other utilities operating in Maryland. However, an eleventh-hour stay was granted on June 30 at the request of the Mid-Atlantic Power Supply Association, a New Jersey-based trade association claiming to represent out-of-state retail marketers.

Christian H. Poindexter, Constellations chief executive, called the courts action yesterday "a major, positive step forward." BG&E said it would put the rate cut into effect retroactive to July 1, pointing out that other Maryland utilities had made the rate cuts on that date.

Poindexter also noted that the New Jersey groups request for a stay "has now been heard -- and denied four times -- by three courts." He added that 23 of the 34 electric suppliers that have applied to the Maryland Public Service Commission to sell electricity in Maryland are from out of state.

The Court of Appeals remanded the case to the Baltimore City Circuit Court for further proceedings. Poindexter said "When the circuit court reviews the merits of MAPSA's appeal, we are optimistic the PSC order will be affirmed because it followed the Maryland Legislature's electric deregulation law by establishing a fair framework for deregulating the electricity market. It is both sound and well reasoned."
