CADWR Sues Allegheny Energy Over Alleged Breach of Contract

LCG, Jan. 30, 2003-The California Department of Water Resources (CADWR) filed suit yesterday against an energy company regarding the transfer of a contract to an affiliate.

Allegheny Energy, Inc.'s unit, Allegheny Energy Supply, had a ten-year electricity contract with the DWR, and in December, the contract was given to the new unit, Allegheny Trading Finance Company.

The Federal Energy Regulatory Commission provided the official okay for the transfer, but the CADWR now asserts that the $4.4 billion electricity contract does not allow for the transfer.

The CADWR further asserts that the contract has therefore been terminated by the alleged breach. The contract was initially signed in March 2001.
