Massachusetts Approves New Legislation Targeting the Development of 1,600 MW of Offshore Wind Power

LCG, August 11, 2016--The Governor of Massachusetts signed into law the Energy Diversity Act (H. 4568) that requires utilities to competitively solicit and contract for approximately 1,200 MW of clean energy generation - base load hydropower, onshore wind and solar supported by hydropower, standalone onshore wind, solar, or other Class I renewable resources. The new legislation includes the procurement of approximately 1,600 MW of offshore wind, and the schedule calls for "not later than June 30, 2017, every distribution company shall jointly and competitively solicit proposals for offshore wind energy generation; and, provided, that reasonable proposals have been received, shall enter into cost-effective long-term contracts."

The Governor said, "Massachusetts is always at the forefront of adopting innovative clean energy solutions, and this legislation will allow us to build on that legacy and embrace increased amounts of renewable energy, including hydropower. With our partners in the Legislature, the Commonwealth has taken another major step towards providing residents and businesses with a cost-effective and reliable clean energy future."

The newly approved legislation states that, "The distribution companies may conduct one or more competitive solicitations through a staggered procurement schedule developed by the distribution companies and the department of energy resources; provided, that the schedule shall ensure that the distribution companies enter into cost-effective long-term contracts for offshore wind energy generation equal to approximately 1,600 megawatts of aggregate nameplate capacity not later than June 30, 2027; and provided further, that individual solicitations shall seek proposals for no less than 400 megawatts of aggregate nameplate capacity of offshore wind energy generation resources."

Thus, with this legislation, the Commonwealth calls for the distribution companies to (i) solicit proposals for offshore wind energy generation within one year and (ii) enter into long-term contracts for offshore wind energy generation equal to approximately 1,600 MW of aggregate nameplate capacity by June 30, 2027.

The Chairman of the House Committee on Ways and Means stated, "By focusing on procurement this bill does the hard work of translating goals into a process that will make them a reality. The 2,800 MW of combined wind and hydro energy approved in the conference report will ensure that Massachusetts remains a national leader on clean energy and will help to secure a more reliable and sustainable future."

The new legislation also provides additional support for the Commonwealth's business community by establishing a commercial Property Assessed Clean Energy (PACE) program. The PACE program, facilitated by MassDevelopment and the Department of Energy Resources, will enable commercial and industrial property owners across the state to finance comprehensive energy efficiency and renewable energy upgrades that are repaid through a property tax assessment on their building.
