LCG, May 14, 2025--The U.S. Nuclear Regulatory Commission (NRC) accepted Dow's construction permit application to build X-energy Reactor Company, LLC's ("X-energy") first small modular reactor (SMR) plant to power a chemical facility in Seadrift, Texas. Dow's wholly-owned subsidiary, Long Mott Energy LLC, is developing the project to provide Dow's UCC1 Seadrift Operations manufacturing site with safe, reliable, and clean power and industrial steam to replace existing energy and steam assets that are approaching end-of-life. The project is part of a demonstration project supported by the U.S. Department of Energy (DOE) and, if approved, would be the first advanced nuclear facility at an industrial site in the United States.

Dabhol Challenges Maharashtra Regulator's Authority
LCG, June 7, 2001Enron India's Dabhol Power Co., beset by bureaucrats from all sides, yesterday filed a petition in the Bombay high court challenging the authority of the Maharashtra State Electricity Regulatory Commission.Enron is mired in a dispute with several tiers on Indian officialdom over its $2.9 billion Dabhol Power Co. facility in the state of Maharashtra. The first 740 megawatt phase of Dabhol began commercial operation last year and the 1,444 megawatt second phase is scheduled to start up this month.In the mid-1990s, the Maharashtra State Electricity Board signed contracts agreeing to purchase all of the output of both phases of Dabhol at agreed-upon prices. Almost since the first kilowatts were generated by the first phase, the MSEB has dragged its feet on making payments for power, forcing Enron to invoke state and federal Indian guarantees.Now, the regulatory commission has added a new layer of bureaucratic obstructionism to Enron's problems. The MSERC has asked Dabhol to refrain from proceeding against the MSEB in the International Court of Arbitration in London. That body was established as the court of last resort in the 1995 agreements between the MSEB and Enron.The MSERC has also asked that Dabhol not avail itself of funds in a special bank account, which is essential to completion of the second phase.Dabhol's petition before the Bombay court challenges the commission's jurisdiction in the matter. The Press Trust of India said the court would respond to the petition next Monday.
