Louisiana Speeds Up Entergy, FPL Merger Review

LCG, Feb. 19, 2001The Louisiana Public Service Commission, responding to a Friday ruling by an administrative law judge, has reschedule to July its hearing on the pending merger of Entergy Corp. of New Orleans with Florida's FPL Group Inc.

The judge's ruling reverses a January judgment that called for hearings to begin in October. Entergy said that schedule would delay closing of the merger by anywhere from three to six months and asked for reconsideration. The company says the new ruling puts the transaction back on track.

Entergy and FPL Group announced their plans to combine on July 31 last year. Since then, both companies received shareholder approval and filings have been submitted to the Federal Energy Regulatory Commission, as well as regulators in Arkansas, Texas, Louisiana, Mississippi, and New Orleans.

The City Council of New Orleans and the Arkansas Public Service Commission will begin hearing this June, hearings before the Mississippi Public Service Commission are scheduled to begin in Marchand a procedural schedule is expected to be issued by the Public Utility Commission of Texas soon, Entergy said.

Though accurately billed as a merger of equals, the deal will be book as a takeover of Entergy by FPL Group. The companies say the combination will be the largest electric distribution company in the U.S.
