FERC to Protect Electricity Information

LCG, September 5, 2002--The Federal Energy Regulatory Commission is considering altering regulations to protect energy infrastructure information from being used by terrorists.

While many are calling for greater transparency in the wholesale electricity market, FERC may change its policy over electricity-related information that might otherwise fall into the hands of those interested in harming the system. Under the new proposal, critical energy infrastructure data, or CEII, would be strictly controlled, and those interested in accessing this information would be required to submit applications including statements of purpose and nondisclosure agreements.

Data that is available already by simple observation, such as the location of electricity and gas lines, would not be subject to the stricter guidelines, while specific facility equipment, transmission data, and production information may become regulated.

FERC will consider public opinion for a period of 30 days before proceeding with more definite plans.
