German Courts Uphold Injunction Against E.On Takeover

LCG, December 17, 2002-German judiciaries continue to block E.On's takeover of Ruhrgas.

E.On, Europe's second largest utility, tried to purchase the German gas company Ruhrgas earlier this year, but various other energy companies complained that the takeover is unlawful and would limit competition.

The Dusseldorf state court ruled this August that the sale had procedural flaws. Today, despite the German Economics Ministry revision of the deal, the court ruled to uphold the injunction blocking the takeover. A final ruling is due in February regarding whether or not the sale will be allowed to continue.

E.On has said it will continue to pursue the takeover with all resources available, noting that the acquisition would secure German gas supply.

Competitors to E.On believe the conditions of the sale are too permissive, and they worry that foreign competition will be forced out of Germany.
