California PUC President Talks of "Cooling Off Period"

LCG, Mar 17, 2003--The president of the California Public Utilities Commission, Michael Peevey, appointed to replace the former president Loretta Lynch late last year, said in an interview with Reuters that the uncertainty about deregulation created by the 2000-2001 energy crisis will require hard thinking about possible directions for the state's power market.

Peevey noted that summer supplies will need to be monitored closely due to dry conditions in the Northwest and lower-than-average snowpack in the Sierras. In order to see that supply remains ahead of demand, the former president of Edison International and its utility Southern California Edison said that strong efforts in conservation and the ongoing installation of new conventional and renewable capacity resources are part of current plans developed between the CPUC and two other agencies.

According to Peevey, "this is the first time that state agencies have committed to work together on a single plan." He said, "We need a hiatus for a year or so, a cooling off period, and then look anew at what kind of market we want to have." The current version of the plan he spoke of would include more small generating plants to be used within demand centers and more pipelines for natural gas.

In reference to the prospect for the state obtaining refunds for previously signed long-term power contracts, the PUC president told Reuters that rather than "accept throwaways from FERC" should any refunds fall short of the $9 billion sought, the state would next have to take the matter up with the 9th District Federal Court in San Francisco.
