Accountant Sues Over Treatment after Whistleblowing

LCG, May 22, 2003-Duke Power Company accountant Barron Stone filed a lawsuit yesterday, alleging the company acted illegally in its treatment of him after he called regulators to complain about the company's ethics.

Stone filed the $2.5 million suit in U.S. District Court in Charlotte, North Carolina.

Two years ago, Stone notified South Carolina regulators and Duke's ethics hotline that he believed Duke Power was making less than legal changes to accounts in order to avoid cutting retail electricity rates.

Stone claims that the company retaliated for his actions by demoting him and harassing him.

Earlier this year the U.S. Department of Labor threw out his claims. In March, the Occupational Safety and Health Administration ruled that there was no indication of management retaliation.

Stone's actions regarding the possible ethics violations brought about a $25 million settlement between utility Duke Power and South Carolina regulators.

Stone is a senior forecast analyst. He is also seeking the reinstatement of his former job.
