Power Purchases Between Southern Affiliates Under Review
LCG, July 9, 2003--Power purchases by the utility Southern Power, a unit of Southern Co., from power plants owned by corporate affiliates, were ordered to be subject to judicial review by the Federal Energy Regulatory Commission. The federal agency gave approval to the long-term contracts, which secure 1,240 megawatts from generating units under construction at Georgia's McIntosh plant, after Southern Power requested such approval. FERC responded in its order to issues raised by Calpine Corp. and the Electric Power Supply Association, which represents merchant generators.Southern Power stated to FERC that the purchases came out of "a highly competitive, state commission-supervised resource solicitation, evaluation and certification process that meets all of the Commission's legal requirements for ensuring just and reasonable rates through a competitive bidding process that was fairly implemented for all bidders."
