EPA Accused of Sidestepping Analysis of Anti-Pollution Proposals

LCG, July 14, 2003--Proposals for cutting pollution that may conflict with proposals put forth by the Bush administration have not been studied by the Environmental Protection Agency, or have been put on the backburner, according to members of both major parties in Congress, employees of the agency, and environmental groups, the New York Times reports.

Studies are undertaken by the E.P.A. regularly by the agency to forecast and model the efficacy, benefits and costs of environmental policies. Senators Joseph Lieberman, D-Conn., and John McCain, R-Ariz., submitted a proposal for cutting emissions of carbon dioxide, a proposal that Lieberman said has received no agency attention due to political pressure. That assessment was countered by a spokeswoman for the E.P.A., who said of the questioning regarding certain analyses that were not conducted, "These decisions were not motivated in any way by politics."

The Times quoted William D. Ruckelshaus, who served as the head of the agency under president Nixon, who oversaw the EPA's creation. "Whether or not analysis is released is based on at least two factors. Is the analysis flawed? That is a legitimate reason for not releasing it. But if you don't like the outcome that might result from the analysis, that is not a legitimate reason."

Senator McCain wrote Christine Todd Whitman, who has since resigned as the agency's head: "I am disappointed that the E.P.A. declined to review the bill and do not feel it was normal procedure to refuse to analyze a bill that is under the agency's jurisdiction." Whitman responded that she "would expect" that any cost estimates by the agency would be closely aligned with those the Energy Information Administration would produce.

While the agency is under court order to develop and implement regulations on limiting mercury emissions within five years, the Times spoke with employees who were present at a March meeting, and said that the assistant administrator for air programs canceled a second meeting four days later, at which they would have presented alternative regulatory options to external representatives.
