Southern Co. Transmission Access Questioned by FERC
LCG, Mar. 17, 2004--Southern Co., which owns utilities throughout the Southeast, has been given 21 days by the Federal Energy Regulatory Commission (FERC) to justify its alleged restriction of transmission access available to Calpine Corp. and Oglethorpe Power Corp.Calpine and Southern have been in talks aimed at reaching a settlement over the issue, but negotiations have not yielded significant progress. According to a FERC order, Calpine and Oglethorpe were not given rightful opportunities to renew existing long-term contracts associated with Southern Co. transmission infrastructure. In another case, Calpine had requested that FERC block a deal Southern had with utility affiliates controlling transmission access from the McIntosh power plant, scheduled to go online next year. Southern has said that its bidding process does not favor any participant. In its order, FERC sought a response to the finding that the contracts "limit the transmission customers' rollover rights in a manner contrary" to the agency's policies.
