Alliant Challenges Wisconsin Utility Investment Law

LCG, Oct. 12, 2000Alliant Energy Inc. went to court yesterday seeking to overturn a long-standing Wisconsin law that prohibits companies from outside the state from investing in Wisconsin utility holding companies.

Alliant, the holding company for Wisconsin Power & Light Co., stressed that the federal lawsuit was procedural in nature. "In effect, we are suing the law itself," said Errol B. Davis, chairman, president and chief executive.

The Wisconsin Utility Holding Company Act was enacted in 1985, before any thought was given to interstate transactions by energy utilities or before deregulation of the electric industries was considered by anyone other than visionaries.

Davis said "While these well-intentioned provisions of state law were designed to encourage investment in Wisconsin, they are having the opposite effect, resulting in Wisconsin-based energy businesses being left at a competitive disadvantage without enhancing economic development, electric reliability or consumer protection."

Alliant said it intends to challenge the constitutionality of the provisions of the Wisconsin law which restrict ownership in utility holding companies and place significant restrictions on companies that invest inWisconsin utility holding companies. The case will also seek to resolve constitutionality issues presented in the current law relating to the asset cap.

"We are simply seeking an impartial federal court ruling on this matter of law," Davis said. "We support the prudent regulation of utilities and embrace the efforts the state has made at improving electric reliability. There is absolutely nothing in this case that interferes with the ability of Wisconsin regulators to regulate Wisconsin-based utilities."

Davis said "Resolution of this issue will empower Alliant Energy to build on our long-standing commitment to Wisconsin and chart a successful course for our next 100 years of growth," adding that it could take up to nine months to get a ruling.
