Protective Order on California Documents Likely to Be Lifted
LCG, Mar. 5, 2003--A spokesman for the Federal Energy Regulatory Commission said today that the agency is taking steps that would allow a protective order on documents concerning California power markets to be lifted.A summary of allegations made by California was made public, although the contents of 3,000 pages the state submitted to FERC were at first thought to require secrecy in order to protect commercially sensitive information. Sen. Dianne Feinstein (D-Calif.) and Gov. Gray Davis have each said that the evidence given to FERC provides undeniable evidence of market manipulation. At least 70 companies were named in the state's summary of its findings.Five days' notice would be provided to those who could dispute California's conclusions about behavior in the markets before the documents would be made public. A decision by either an administrative law judge or the commission itself would be sufficient to remove the protective order. Sen. Feinstein said in a press release that she had been made to understand by FERC Chairman Pat Wood III that the commission intends to remove the order.
