Subcommittee Vote Favors More FERC Authority

LCG, Mar. 21, 2003--A bill that passed the House energy and air quality subcommittee 21-9 gives support to the Federal Energy Regulatory Commission's planned increase in the agency's control over interstate transmission issues, and lowers barriers to new transmission siting.

The bill would also repeal the Public Utility Holding Companies Act, known as "Puhca". Puhca restricts mergers on a large scale, but was thought by Subcommittee Chairman Joe Barton (R-Tex.) to restrict infusions of capital unnecessarily where they could spur expansion of the transmission grid. Rep. Rick Boucher (D-Va.) amended the bill so that FERC would conduct reviews of utility mergers, which are also overseen by agencies specializing in antitrust matters.

Provisions were included that would increase FERC's oversight of utilities at the municipal and federal level, as well as cooperatives, increasing regulation of some service territories where it has historically been minimal. Another part of the bill gives federal regulators "eminent domain" in matters of transmission siting, in cases in which states fail to grant approval following one year after the original application.

Some members of the committee would have liked to have waited for the FERC's decisions on Western contract disputes before the vote on the bill. The rulings had been expected late this month. The full House Energy and Commerce Committee plans to take up the bill early in April.
