LCG, July 10, 2025--The U.S. Nuclear Regulatory Commission (NRC) accepted a construction permit application for review from the Tennessee Valley Authority (TVA) to build one of the nation’s first small modular reactors (SMR). TVA submitted its application in late May to use GE Vernova Hitachi’s BWRX-300 design and to install the advanced nuclear plant at its Clinch River site near Oak Ridge, Tennessee. TVA's application is the first in the U.S. that uses GE Vernova Hitachi’s BWRX-300 design.

U.S. Appeals Court Upholds EPA Greenhouse Gas Regulations
LCG, June 27, 2012--The U.S. Court of Appeals for the District of Columbia yesterday issued its ruling in support of the Environmental Protection Agency's (EPA's) Greenhouse Gas (GHG) regulations that impact vehicles, power plants, and other stationary sources that emit greenhouse gases.
The Court concluded: (i) the Endangerment Finding and Tailpipe Rule are neither arbitrary nor capricious; (ii) EPA?s interpretation of the governing Clean Air Act (CAA) provisions is unambiguously correct; and (iii) no petitioner has standing to challenge the Timing and Tailoring Rules. The court dismissed for lack of jurisdiction all petitions for review of the Timing and Tailoring Rules, and denied the remainder of the petitions.
An attorney for the Natural Resources Defense Council (NRDC) stated, "These rulings clear the way for EPA to keep moving forward under the Clean Air Act to limit carbon pollution from motor vehicles, new power plants, and other big industrial sources." The National Association of Manufacturers (NAM) President stated, "Today's ruling is a setback for businesses facing damaging regulations from the EPA....The EPA?s decision to move forward with these regulations is one of the most costly, complex and burdensome regulations facing manufacturers....We will be considering all of our legal options when it comes to halting these devastating regulations. The debate to address climate change should take place in the U.S. Congress and should foster economic growth and job creation, not impose additional burdens on businesses."
The next step may be for the plaintiffs, which include industry and utilities, to take the case to the U.S. Supreme Court.
