NRC Rules to Defer New Reactor License and License Renewal Decisions
LCG, August 8, 2012--The U.S. Nuclear Regulatory Commission (NRC) voted yesterday to defer issuance of final decisions to grant licenses to construct nuclear power reactors or renew 20-year licenses for existing reactors until resolution of the NRC's waste confidence rule that was recently overturned by an appeals court.
The NRC commissioners did order (i) the NRC to continue to review license applications and (ii) the NRC's Atomic Safety and Licensing Board Panel to not accept or deny new challenges associated with nuclear waste storage.
An NRC spokesperson stated that the new order does not impact previous licensing decisions or license renewals issued by the NRC.
On June 8, the U.S. Court of Appeals for the District of Columbia Circuit struck down the NRC's updated waste confidence rule and stated the NRC is required to conduct an environmental assessment of the rule. The court stated the NRC had "failed to properly examine future dangers and key consequences" of storing used commercial nuclear fuel at power reactor sites for decades. The court also stated that the NRC ?has no long-term plan other than hoping for a geologic repository."
The NRC action was pursued in a petition filed June 18 by 24 groups requesting the NRC to freeze final license decisions until it completes a rulemaking action on the environmental impacts of radioactive nuclear wastes.
The NRC commissioners stated, "Because of the recent court ruling striking down our current waste confidence provisions, we are now considering all available options for resolving the waste confidence issue," which could include the issuance of a revised generic regulation, a regulation that would assess waste nuclear fuel on a site-by site basis, or a combination of both.
